    Advertising agencies or website designers are responsible for reviewing the information used to substantiate ad claims. They may not simply rely on an advertiser's assurance that the claims are substantiated. In determining whether an ad agency should be held liable, the FTC looks at the extent of the agency's participation in the preparation of the challenged ad, and whether the agency knew or should have known that the ad included false or deceptive claims.

    To protect themselves, catalog marketers should ask for material to back up claims rather than repeat what the manufacturer says about the product. If the manufacturer doesn't come forward with proof or turns over proof that looks questionable, the catalog marketer should see a yellow "caution light" and proceed appropriately, especially when it comes to extravagant performance claims, health or weight loss promises, or earnings guarantees. But he made you pay for something which he claims it works but doesn't now you wasted your money. its like someone advertising a multi-functioning gadget which can do 11 things all from this one thing but when you buy it you can probably just do 3 the rest were just hyps/gimmicks, can't you sue this person for false advertising. its probably different the legislations in the US.

So if the FTC were to get involved don't the people who were victims of their misleading adverts get any sort of compensation?

* He sat on the bench for Bulleen ABA
* Never played any minutes or even suited up for the Victorian Titans.
* Never approached by any college or NBA team (my god what a lot of shit)
* His qualifications in any fitness area is a gym instructor
* He has never had any previous or further studies in human performance
* Any trainer who works with atheltes is happy to name them as it gives them credibility

This guy is a marketing genius. Seriously. He recently sent out a video offering up the chance to win his old Ferrari but first you have to pay him $9.95 to keep using your copy of Double YouR Vertical Leap that you originally paid whatever for (inlcuding the secret monthly coaching rip off fees), and then you will be required to pay him another $200 to enter his Ferrari competition.

I have never seen anyone come up with so many dodgy ways of scamming money off people. I am actually staggered by the gall of the guy.
